A short Review of the Notary Public Act 2023
The Notaries Public Act, 2023 has been enacted to replace the previous Notaries Public Act, Cap. N141, Laws of the Federation of Nigeria, 2004. The new act provides for the appointment and registration of Notaries Public, regulates their duties, and makes provisions for digital and remote notarization of documents in Nigeria.
A Notary Public can witness the execution of various documents, prepare notarial certificates, administer oaths, take affidavits, notarize bills of exchange, verify company documents, and perform digital notarization through electronic means. Before commencing their duties, a Notary Public must take an oath as set out in the First Schedule of the Act.
The Chief Registrar of the Supreme Court will maintain a register of all appointed Notaries Public, which will be available to the public. Notaries Public can perform their duties electronically after registering with the Chief Registrar and obtaining an official digital signature.
