CLASFON secures release of inmates pro bono

The Christian Lawyers Fellowship of Nigeria, CLASFON Abuja Branch today secured the release of Mr. Benjamin Musa.

In a report by counsel to the defendant, Ayodele Adepitan stated that the case was one of the probono cases done by CLASFON.

The case was mentioned around noon and it was slated for hearing. The prosecutor was present while Ayodele Samuel Adepitan Esq., appearing with Sunday Luka Esq., jointly announced appearance for the Defendant.

The Prosecutor informed the Court that, he received a report from his superior to wit, he was asked to terminate this case however, he is still awaiting their final feedback as he wants an officer of the Nigeria Police Force to be on the ground to re-arrest the defendant based on conducting further investigation on this matter. However, he applied that, based on this forgoing, he leaves it at the discretion of the Court.

The Defence informed the Court that, they have few applications to make to wit: an earlier application made in respect of the seized mobile phone and ATM card respectively of the Defendant by the Nigeria Police Force right from when he was arrested, in lieu of this, the Defend hereby prayed this Honourable Court to Order the Prosecutor to mandatorily to return the these seized items to the Defendant.

Secondly, the Defence applied that, based on the nature and circumstances behind this case, plus the submission of the Prosecutor, the Defendant be discharged pursuant to Section 396 of the Administration of the Criminal Justice Act (ACJA), 2015 as the Prosecutor has not placed anything before this Honourable Court against the Defendant to warrant his trial.

The Defence prayed the Court to grant their prayer in the interest of justice; as the Court is the Court of Justice and Law.
The Court ruled that this case is hereby dismissed against the Defendant and he is hereby discharged pursuant to Section 396 of ACJA, 2015 however, regarding the seized items, the Court ruled that these items are not contained in the FIR that birthed this case hence, the Defend should come properly before the Court and put the other party on notice.

To the glory of God, the Defendant (Benjamin Musa) is now a FREE man. Forsooth, his family would be happy to see him again most especially his wife after a lengthy spell in the Nigeria Correctional Center since last year.
