Defection: Declare Hon. Nonso Okafor’s Seat Vacant – Lawyer writes Anambra House of Assembly
Abuja based Lawyer and human rights Activist, Mercel Dim-Udebuani Agams Esq, has asked the Honorable Speaker of Anambra State House of Assembly Awka to immediately declare the seat of Hon. Nonso Okafor Vacant.
Agams made this request in a petition dated 20th September, 2021 stating that Hon. Okafor a member representing Nnewi-North constituency in Anambra State house of Assembly under the platform of All Progressive Grand Alliance (APGA) has contrary to the constitution defected to the All Peoples Congress (APC) .
The Lawyer further threatened that if his request is not met after 21 days, he would approach the law Court to compel the house to do the needful in the interest of Nnewi people.

NONSO OKAFOR, MEMBER REPRESENTING NNEWI-NORTH CONSTITUENCY IN ANAMBRA STATE HOUSE OF ASSEMBLY VACANT IN LINE WITH SECTION 109 (I) (G) OF 1999 CONSTITUTION OF FEDERAL REPUBLIC OF NIGERIA (AS AMENDED) AND IN VIEW OF THE DECISION OF THE SUPREME COURT OF NIGERIA IN THE CASE OF HON IFEDAYO SUNDAY ABEGUNDE VS. ONDO STATE HOUSE OF ASSEMBLY AND 12 ORS (2015) LRELR-24588
My name is Sir (Barr) Marcel Chukwuma Dim-Udebuani aka (Agams), the Principal Counsel of Dim-Udebuani & Co. I am a native of Umuezeokalum Umudim Nnewi and the present legal adviser of Nnewi Community Meeting, Abuja.
I write to your distinguished office as the Speaker of Anambra State, House of Assembly as follows:-
- That Hon. Nonso Okafor is the member representing Nnewi–North Constituency in Anambra State House of Assembly under the platform of All Progressive Grand Alliance (APGA) and who recently defected to the All Peoples Congress (APC).
- That by virtue of Hon. Nonso Okafor’s defection from the party that sponsored his election to the House of Assembly before the expiration of the period of which he was elected he ceases to become a member of the House of Assembly of our State.
- That the reasons stated by Hon. Nonso Okafor for his defection contained in his political journey to APC published on the 8th September, 2021 https:/m.facebook.com/story.php?storyfbid=382138230022283&id=106968824205893 are not within the exceptions allowed by our Constitution. - That the facts of the present Hon. Nonso Okafor case is in pari materia, that is on all fours with that of Supreme Court decided case of Hon. Ifedayo Sunday Abegunde vs. Ondo State House of Assembly & 12ors (2015) LRELR-24588 and the only option left for you as the Speaker is to declare the seat of Hon. Nonso Okafor vacant in line with the judicial authority.
Finally, as a Notary Public and one of the persons Hon. Nonso Okafor is representing, I shall approach a court of competent jurisdiction after (21) days if his seat is not declared vacant and seek by way of originating summons compelling you to do so for the greatest interest of Nnewi people who without hesitation condemned the All Progressive Congress (APC) he defected to because they never voted for the party and will never vote the party because of their obvious leadership misrule and he has no justification whatsoever in doing so.
