Hon. Uchenna Fortunatus Ogbonna drags PDP, Hon. Jane Eneh & ors to Court
Hon. Uchenna Fortunatus Ogbonna has dragged the Peoples Democratic Party, Enugu State, Hon. Jane Eneh and P.D.P Electoral Committee of Enugu State to court over the purported nomination of Hon. Jane Eneh as P.D.P candidate for Awgu North State Constituency.

In the suit filed at the Federal High Court sitting at Enugu with No. FHC/CS/82/2022, Hon. Ogbonna is asking the court to restrain the P.D.P and I.N.E.C from parading Hon. Jane Eneh as the P.D.P flag bearer for Awgu North State Constituency as she was not elected in a proper primary election of the P.D.P. Hon. Ogbonna who is an aspirant to represent Awgu North State Constituency under the platform of P.D.P alleged a total breach of the Electoral Act 2022, Constitution of the P.D.P, and Primary Elections Guidelines of the P.D.P in the purported election of the said Hon. Jane Eneh and is asking the Court to nullify her election as it cannot stand given the clear provisions of the Law.
According to the Court papers filed by his Counsel, Uchechukwu Onyekachi Esq, the Plaintiff alleged that what the Electoral Committee of P.D.P in collaboration with P.D.P and Hon. Jane Eneh did negates every democratic principle observed in the conduct of any election.
He regretted that P.D.P, a political party that holds itself out as a democratic institution could ever set up and perfect a scheme that makes a mockery of a proper electoral process.
Commenting on the suit, the Plaintiff said āPDP Enugu State should hide their face in shame. What they are doing is pure fraud. How can you ask people to go and buy form and pay other sundry fees when you donāt intend to conduct any election.?
“What kind of system is that? You know who you want to select and you allow other aspirants to waste their hard earned money only for you to chase both the aspirants and their agents out of the election venue with the aid of armed men and later pronounce an already made result and declare Jane the winner.
“Is that an election? No, that is a sham. What are they afraid of? They know that if an election is conducted, Jane cannot beat me. She cannot even come second as some of the other aspirants are more popular than her. This is someone who has not delivered during the time she has spent in the House and the people that believe that they own the party is selecting her again. What has she done, tell me one bill that she has sponsored or any constituency project that she has done. Nobody in the party in Awgu North supports her. So where is she getting elected from? Just a few people from the party is forcing her on us. Look at PDP, you tell aspirants that there will be an election so why not allow the election to go on with your hand-picked delegate. They are just afraid of my popularity in Awgu North and my competence. Thatās why I have come to court. Let the Court decide if this illegality called election would be allowed to stand. I trust and believe in the court process and I believe itās time that we begin to sanitize the electoral process, starting from the political parties. Because political parties are now obtaining money from people under false pretense. They will tell you that the primary election will be conducted but they will not conduct anything. They will write results and muzzle other aspirants out. Is that the system to be proud of? And when you complain to the party nobody will listen to you or look into the illegality. Listen, the delegates that were even hand-picked by the āowners of the partyā believe in my candidacy. So allow them to choose the partyās candidate and you say no.ā
At the time of this report, BarristerNG gathered that Hon. Jane Eneh have been purportedly elected as the P.D.P flag bearer for Awgu North State Constituency but the Plaintiff is asking the court to declare her election as null and void and restrain INEC from publishing her name or treating her as the elected candidate of PDP for Awgu North State Constituency.
Reacting in a chat with BarristerNG, the Plaintiffās Counsel said: āLet us challenge and change this system. Itās clear fraud to ask people to aspire for an office and you end up picking one person without a proper election. And I know and trust our courts, they have proven over time their readiness to change a bad system. You know where we are coming from…you remember when unlawful substitution of a nominated candidate was the order of the day and the court stepped in and put a stop to it. Now, what is taking over is a dictatorship in political parties where a few persons, sometimes one person, says who gets what and when. That is not the internal democracy that they all preach and claim to observe,” he concluded.
BarristerNG gathered that parties have been served and the matter fixed for hearing.
