4.0 MATTERS ARISING FROM THE PREVIOUS MINUTES
Matters arising from the previous minutes were presented by the General Secretary, Isiaka Abiola Olagunju, on the following major subheads;
4.1 Abuja and Ikeja Branches Election Issues
The General Secretary reported that after the inauguration of the current administration, the President made concerted efforts to reconcile parties and ensure peace at the aforementioned branches of the NBA. He reported that committees were set up to reconcile these branches and/ or advise him on the appropriate step to take where reconciliation was not possible.
4.1.1 For Ikeja branch, an Elders committee led by Dr. Muiz Banire, SAN was set up. He stated that as at the time of the NEC meeting, no report had been received from the Committee.
4.1.2 For the Abuja branch, a three man Reconciliation Committee was set up, led by Chief Kanu Agabi, SAN, with Mrs. Bisi Soyebo, SAN and Offiong O. Offiong SAN as members. He informed the NEC that the report of the Abuja committee was received shortly before the NEC Meeting and as such was not included in the already printed NEC Bundles for the Minna NEC meeting. He also stated that the Chairman of the committee, Mr. Kanu Agabi, SAN, who was unavoidably absent, had requested that a member of his committee, Mr. Offiong O. Offiong, SAN present the report to NEC on behalf of the committee. He pleaded with NEC that the matter be stood down till the arrival of Mr. Offiong SAN, who was still on his way from Abuja due to other tight engagements.
4.2: Reports Expected from Matters Arising
The GS stated that reports would also be expected from the following committees in the course of the NEC meeting as arising from the previous minutes;
Post Conference Report of NBA-AGC, Port-Harcourt 2016. (pages 74A-E of the NEC bundle).
Section on Business Law (SBL) pages 33-35 of the bundle
The NBA Building Committee.
The Committee on the request of the Supreme Court for the remittance of 10% of BPF to the Supreme Court.
The NBA Peace and Reconciliatory Committee on Election matters.

5.0 PRESIDENT’S SPEECH
The President welcomed all members of NEC to the first NEC meeting of his Administration and thanked them for sparing time to be at Minna for the meeting.
He went ahead to state that his speech was meant to give a general update of his Administration’s stewardship from inauguration to the time of NEC at Minna.
Major highlights of the President’s speech include;
5.1 Vision of the A. B. Mahmoud Administration
He reminded NEC members of his BRAVE NEW BAR mantra. He emphasized that building a brave new bar remains the focus of his administration. He stated that his administration had encapsulated the vision: “To re-invent the Nigerian Bar Association into a brave new bar driven by the knowledge and skills of its members as a veritable agent for National transformation while safeguarding the interest of its members”. He maintained that this has been the battle cry of his administration which is centered on four thematic areas of; Regulation, Representation, Re-engineering and Public interest (3Rs& P) and that his focus in the last few months has been on how to break this down into clear deliverables with clear timelines.
5.2 The NBA and the EFCC
The President took time in his speech to explain to NEC members, the steps he had taken in dealing with the controversy that emanated from his inaugural address. He condemned the EFCC’s distasteful act of calling lawyers ‘rogues and vultures’ in reaction to his honest inaugural speech where he suggested stripping the anti-graft agency of its prosecutorial powers and leaving it only with the power to investigate. He however informed officers that the EFCC Chairman had called to apologize and had also gone ahead upon insistence of the President, to publish a retraction of the ugly publication. The NBA had also made a press release on the subject matter.
He further informed the meeting that in the meantime, the NBA Anti Corruption Committee which will soon be inaugurated will be making a detailed study of these issues as they affect these agencies and would be making necessary recommendations to the Federal Government and the National Assembly.
5.3 The NBA’s Position On The arrest Of Judges /Justices By The DSS
5.3.1 The President narrated in detail the burning issue of the commando- styled arrest of judges’/justices by the DSS which he stressed has generated divided interests and concerns amongst members of the Association. He regretted that some colleagues misinterpreted his latest statement on the matter to mean a retraction of NBA’s earlier position. He then reiterated that the NBA’s position which condemned the commando-style invasion and arrest of judges’ by masked men in the middle of the night, had not changed. He commended all the Past Presidents of NBA and other Bar Leaders for prompt response to his call in Lagos during the said period.
5.3.2 The President further explained, that his second official statement on the matter asking that the affected judges’ should step aside pending the conclusion of their trials did not in any way controvert the earlier position of the bar. However, in consultation with the Crisis Management Committee set up to monitor the ugly incident, was of the view that if a judge is being investigated and he makes a public statement suggesting that he was complicit, especially in respect of our justices at the Supreme Court and other superior Courts, it was inappropriate for the judge to continue to discharge his judicial responsibilities without diminishing the credibility of the institution. He maintained that it was on the basis of this that the Association suggested that the NJC ask those judges to recuse themselves from further judicial functions until their matters are completely resolved. He mentioned that he made a report to the Body of Senior Advocates of Nigeria and they also accepted and adopted that position, with the NJC eventually seing reasons with this and taking the same stand.
5.3.3 The President further reported that a fall out of the entire judges/justices’ arrest is that the NBA used the opportunity to emphasize the need for its members to be fully engaged with the NJC not only on appointment of judges but also in the discipline of judges. He lamented the practice at NJC where constitutionally, the NBA can only take part in the appointment of judges but no responsibility when it comes to the discipline of judges. He informed NEC that the Association is currently insisting on a review of that provision, arguing that since NJC is a body, all members should have full and equal responsibilities. He stated that this position has been accepted by the NJC in principle and they have made the relevant recommendations in the current review of the Constitution. He said the NBA would also reinforce that when making submissions to the National Assembly.
5.4 Bar Leaders Summit
The President gave an overview of the Summit which was held at the Transcorp Hilton Hotels Abuja on the 11th day of November, 2016. He informed the meeting that Mrs Funke Adekoya SAN would be presenting a report to the NEC on the key resolutions reached at the summit as well as the implementation strategy if approved by the NEC.
5.5 NBA Stamp/Seal Review committee
He stated that in a bid to stymie all operational hiccups/complaints arising from the NBA stamp and seal policy, a committee was set up, headed by Boma Ozobia with a mandate to review the entire process and come up with recommendations on how to improve on it. He further informed NEC that the Committee has submitted its report to the National Officers with some recommendations on improving the process. He said the committee would be presenting the same report to NEC in course of the meeting.
5.6 North East and Niger Delta Task Forces
The President also informed NEC of the setting up of two NBA committees with the aim of providing succor to our colleagues affected by the insurgency and militancy in the North East and Niger Delta Regions respectively, which will by extension support the Government in the fight against militancy and insurgency.
5.6.1. The North East Task Force is headed by Prof. Mohammed Tabiu, former Chairman of the National Human Rights Commission. Other members of the committee include;
Prof. Ayo Atsenuwa – Alternate Chairman Prof. Isa Hayatu Chiroma – Member Rakiya Mukhtar Tofa – Member Altine Ibrahim Esq, – Member Hafsatu Mohammed Esq. – Member Hassan Maidoki Esq – Member Lauretta Adaeze Esq – Member Hauwa Shekarau (Ms) – Member Amina Ibrahim (Ms) – Member Ronke Ige (Ms) – Member
Alfa Ibrahim Esq. – Member Isa Muhammad Nurudeen Esq – Member Kunle Adegoke Esq        – Secretary.

5.6.2. The Niger Delta task force is headed by Chief Albert Akpomudge, SAN.
Other members include;

Ledum Mitee Esq -Alternate Chairman
Mia Essien SAN – Member Mba Ukweni, SAN – Member Q. E. B. Offiong SAN – Member Charles Ajuwa, SAN – Member Sosoprieye Long Williams, Esq – Member Kelvin Ejelonu Esq – Member Muyiwa Olowokure,Esq – Member Sagir Gazawa,Esq – Member Mrs. Lillian Ene Ogar – Member Nkiruka Maduekwe, Esq – Member Alex Mouka Esq. – Secretary.

The President further stated that his attention had been drawn to some criticisms on the constitution of these committees emanating from certain branches. Their complaints range from not being properly consulted before the appointments were made and/or not being adequately represented. He apologized for the oversight, but went further to state that the task forces are not necessarily representing branches but rather focus on National assignment.
The President further stated that the two task forces will be submitting reports periodically to him and the NEC.
5.7 NBA Abuja and Ikeja Branches’ Crisis
The President gave a recap of the Ikeja and Abuja situation as reported by the General Secretary earlier. He stated that he had set up committees to look into both cases and that the Abuja report would be received in the course of the meeting, while the Ikeja committee were yet to turn in any report as at the time of NEC meeting.

5.8 NBA Properties
On the state of NBA properties, the President informed NEC that he had mandated the ED to present a detailed report on all NBA properties and would keep NEC posted as soon as he gets a fuller brief. Notwithstanding, he reported that NBA is yet to get buyers for the former NBA House at Oro-Ago, Garki Abuja which NEC had given approval for sale so as to generate funds for the completion of the New NBA House, which by rough estimate would require over 380 Million Naira for completion excluding furnishing which has been quoted to cost over 150 Million Naira. He said he also expects report from Babalakin’s company in Lagos to ascertain the state of one of the two buildings in Lagos. He maintained that these details are necessary to determine the position of the properties so that the Bar can generate rental income from them.
5.9 NEC Approval for Constitution of Committees
The President sought NEC approval to constitute and inaugurate the following committees within the next few weeks;
Judiciary Committee, Rule of Law Action Group, 2017 Conference Planning Committee (TCCP), NBA Institute of Continuing Legal Education Governing Council, NBA Human Rights Institute Governing Council, NBA Anti Corruption Commission and the NBA Welfare committee. Others include; NBA Election Working Group, NBA Women Forum, NBA Academic Forum, NBA Young Lawyers Forum, NBA Section on Public Interest & Development Law, NBA Legislative Advocacy Committee, Section on Legal Practice Governing Council and NBA Committee on Review of the Regulation of the Legal Profession.
He sought NEC ratification for the committees already inaugurated before the NEC meeting and other steps taken by himself and the National Officers on behalf of the Association prior to the NEC meeting.
5.10 Adoption of President’s Speech
Olumuyiwa Akinboro, SAN, Past General Secretary moved a motion for the adoption of the President`s Speech which was seconded by Moses Eroban of the Effurrun Branch.
5.11. Discussion And Ratification of Steps Taken By The President
The President’s speech was extensively discussed and thereafter, Aare Olumuyiwa Akinboro, SAN, Past General Secretary moved a motion for NEC ratification of all steps taken by the President and National Officers on behalf of the Association prior to the NEC meeting in Minna. The steps include; the constitution and inauguration of committees, position on DSS raid, Ikeja and Abuja reconciliation committees and the proposed action plan on NBA properties. The motion was seconded by Mr. Dennis Agbaga, Chairman of NBA Efurrun Branch.
