In a Press Statement signed by King Oziwe A. Amba, President of the NDCA, and Chief Julius O. Bulus, its National Secretary, the suit with number FHC/ABJ/CS/1190/2025, pending before Hon. Justice Omotosho of the Federal High Court, Abuja, contends that the National Assembly contravened the 1999 Constitution (as amended)—specifically Section 305(6)—which mandates a two-thirds majority vote from both legislative chambers to approve any presidential proclamation of a state of emergency.

The group further alleges that such a proclamation must originate from the Governor of the affected state, and claims this prerequisite was ignored, making the intervention in Rivers State “unconstitutional and politically motivated.”

The NDCA has therefore sued for ₦10 trillion in damages, citing disruption of governance, political vendetta, unconstitutional budgeting, and unauthorized expenditures in Rivers State. The plaintiffs are also demanding restitution for what they describe as the erosion of the four-year tenure of the duly elected state administration.

Additionally, the suit presses for recognition of the applicants’ rights to self-rule and self-determination, framing the current crisis as not just a political issue, but one that infringes on fundamental civil rights.

“The National Assembly acted ultra vires, enabling political vendetta through illegal appointments and convoluted budgeting processes outside their constitutional mandate,” the NDCA stated.

The matter comes up tomorrow, 3rd July, 2025 for hearing.
